AI data centre in Germany: what businesses should check.
“Hosted in Germany” appears on many AI offers. Whether your data really stays under German and European law depends not only on the location, but also on the operator, its service providers and the language model. This guide shows what to check, with every provider, including us.

Key points
- A data centre in Germany ensures data residency: the data is stored here. Who can be compelled to disclose it, however, depends on where the provider and its service providers are based.
- So check three levels: where the servers are, the operator and its jurisdiction, and every service provider with access, including the language model.
- The language model is the most common gap: if it runs at an external provider, questions and passages go there, even if documents and index are in Germany.
- RAGSuite Engine is hosted in Germany, operated by NITSAN GmbH of Dresden: documents, index and history sit in a data centre in Germany. Where the language model runs, we answer under “Where does the AI run?”. The data centre and all sub-processors are listed in the Trust Center and the data processing agreement. If you want everything in-house, run RAGSuite yourself.
Why an AI data centre in Germany matters.
With AI applications, the provider holds not only your documents but also the search index, the histories and every question your staff ask. A location in Germany brings three benefits, but it does not answer every question.
Data residency
Data and index are physically in Germany. That simplifies documentation for data protection and customers.
If no one accesses the data from a third country, transfer mechanisms such as the Data Privacy Framework are not needed.
Data Privacy Framework →Short distances
Nearby data centres keep response times low, especially with many requests a day.
What location does not settle
The data centre’s address does not tell you who runs the service and which law applies to it.
Location, operator, jurisdiction: the difference.
The terms are often mixed up. For a sound decision, separate four levels:
locationjurisdictionDPAmodel| Level | Question | Why it matters |
|---|---|---|
| Location | In which country are the servers? | Data residency and response times |
| Operator | Which company runs the service, and where is it based? | Its seat determines which law applies to disclosure orders |
| Jurisdiction | Is the operator or a parent company subject to a third country’s law? | The US CLOUD Act, for example, can compel providers under US law to disclose data, including data stored abroad |
| Service providers | Who else has access, such as the data centre, support or model provider? | Every sub-processor extends the chain |
A provider based in Germany without a parent company under US law is assessed differently from the German region of a US provider. The question is not settled automatically, though: check the data centre operator, service providers and model provider one by one.
Eight questions to ask an AI provider in Germany.
Ask every provider these questions and get the answers in writing, in the data processing agreement. Tick what is settled; nothing is stored.
Running language models in Germany: LLM hosting without gaps.
Many offers store documents in Germany but send the request to a language model abroad. For an unbroken chain there are three routes:
Model with the same operator
The language model runs at the provider itself or at a service provider in Germany or the EU named in the contract. Ask specifically.
A local model, for example via Ollama, runs on your servers. Then no request leaves your network.
RAG with Ollama →Your own API key
If you use a model provider with your own key, check its contract and location like any service provider.
A note on choosing
Good platforms show during model selection whether questions and passages leave your environment.
Self-hosting as an alternative.
If you want to avoid the operator and service provider question entirely, run the AI yourself in your own data centre; with an external host, check it like any service provider. With RAGSuite, it is the same software as in RAGSuite Engine.
Operated by NITSAN GmbH in a data centre in Germany, from €39 a month billed yearly, plus VAT.
RAGSuite Engine →Community Edition free; Enterprise with roles, a full audit log and support for running without an internet connection, on request.

Is a data centre in Germany enough for data protection?
It is a good basis, but not everything. The location ensures the data is stored in Germany. Who can be compelled to disclose it depends on where the operator and its service providers are based. Also check where requests to the language model go. Our answer: RAGSuite Engine is hosted in Germany; AI processing in the EU/EFTA (Microsoft Azure).
What does the CLOUD Act mean for data centres in Germany?
The US CLOUD Act can compel providers subject to US law to disclose data, even if it is stored in a data centre in Germany. So what matters is whether the operator or a parent company is subject to US law, not just the address. This is not legal advice. For RAGSuite Engine: Microsoft is a US company. AI processing stays contractually in the EU/EFTA, stored data stays in Germany, and your data is not used for training. If your data must not touch a US company, use your own API key with a provider of your choice, or run RAGSuite on your own server.
What is LLM hosting in Germany?
The language model itself runs on servers in Germany, at the provider or with you. Only then do questions and passages stay in the country too. Many offers store documents in Germany but use a model abroad; ask specifically.
Where does RAGSuite Engine run?
In a data centre in Germany, operated by NITSAN GmbH, based in Dresden. RAGSuite Engine is hosted in Germany: platform, documents, search index and history sit on our server in a data centre in Falkenstein. AI processing in the EU/EFTA (Microsoft Azure): answers and embeddings are generated by Azure OpenAI in the EU Data Zone, within Microsoft’s EU Data Boundary (EU plus EFTA states such as Switzerland and Norway). Data Azure stores stays in Germany. For answers, your question, the recent conversation and the matching passages go to the model; when indexing, the text sections of your documents are processed for embeddings. The data centre and all sub-processors are listed in the Trust Center and in the data processing agreement.
Can I run RAGSuite myself?
Yes. The Community Edition is free and open source under Apache 2.0; you install it on your own server. Enterprise adds roles, a full audit log and support for running without an internet connection, at a fixed price on request.
Hosted in Germany, or entirely in-house.
Jürgen shows you RAGSuite Engine and the route to your own server and goes through the questions with you.
